Ann Romney and Chris Christie delivered two different messages on the first night of the Republican Convention. Ann Romney talked about the importance of love, but Chris Christie said love wasn't as important as respect. On the face of it, the two messages seemed in discord, but actually the messages were well-aligned, at least politically. Love Mitt Romney enough to elect him and then respect him when your love is tested because he's making the hard choices that a president must make.?
This kind of pitch works with marriages where the odds are stacked against the young couple. The groom tells his bride that their life together is going to be hard. "I don't care," she says. "I love you." "We're only going to be able to afford ramen and tap water,"?he says. "I don't care," she says. "I love you." He persists: "You're going to have to walk a half an hour to the bus stop because I can't make the car payments." She is resolute: "I still love you." In the end, passion and trust overcome whatever fears there are about the future.?
On Tuesday night, Ann Romney and Chris Christie were marriage counselors. Ann Romney tried to vouch for the groom's credentials. Don't worry about this union, she said in effect, I know him better than anyone, and he's a trustworthy guy. He'll work hard. You'll get home safe from whatever journey he takes you on.
Chris Christie spoke on behalf of the clear-eyed groom. Times are going to be hard, but it'll be worth it in the end. You can believe that things will be better because the groom is being straight with you about how hard the road will be.?Honesty as an?aphrodisiac.?
What's a bride (or a voter) to do? If you are already in love with the handsome man from Detroit, you probably already have been texting him about meeting in the alley to?elope. On the other hand, you could just be stringing him along to make your old boyfriend jealous (and confuse pollsters). If you are somewhere in the middle, you have a dilemma (or you are now the main character in one of this fall?s new romantic comedies). Which of the two counselors should you listen to??
Ann Romney made a solid case, but it was limited. If someone is undecided, you can't just assert that she should ignore all warnings.?So perhaps Ann Romney helped some people lean a little more toward this squeaky clean fella, but you could understand if they were still looking for a little more from Gov. Christie about this suitor's prospects. But after 20 minutes of Christie talking about himself and Bruce Springsteen, I doubt Christie?s words made the choice any clearer. Indeed, some may now want to marry Christie. Others may be a little spooked. In the sales pitch, Christie talked about how hard things were going to be. The couple is going to "live, not by avoiding truths, especially the hard ones, but by facing up to them."
Well, just how hard are things going to get? Christie won't really say, but he does keep talking about how things are going to be hard and tough choices are going to be made. You probably want specifics?after all, this is a big decision?but Counselor Christie only repeats generalities that you have heard from so many suitors before. One thing he's very clear about, though: hard choices.
It's time to step off this imperfect metaphor before someone gets hurt. But the topic of hard choices deserves a closer look.?
Tuesday night, Christie defined hard choices as those that are difficult because they anger voters and therefore put a politician in political peril. Christie wants points for brave decisions he made in New Jersey, and he wants Mitt Romney to get bravery points, too. But there?s a difference: Romney is seeking an advance bravery credit. Having not been elected president, he's not actually made any hard choices. He hasn't really talked about them either. (Though, like Christie, he promises he will.) If Romney and Christie really believed in the hard-choices formula, they'd get specific about the hard choices now, explaining to people the trade-offs they?re going to face and the government assistance they?re going to have to do without. (Think about how many bravery points they could win then.) But the hard-choice theory of politics doesn't really call for candidates to announce hard choices. Or, to think of it another way, it's a promise to diet in the future, which you bolster by pointing out how poorly your colleague's diet is working.?
Make no mistake, the hard choices will be hard for the people who will be affected by them, whether it's in reduced Medicare benefits, barred access to financial aid, or bumpy roads from a drop in infrastructure spending. The pain from not addressing the budget imbalance will also have hard consequences.?There is going to be change resulting from the unsustainable budget deficit. That change will come from Democratic policies, Republican policies, or no policies. Voters are looking for someone to trust in handling the belt tightening.?And that takes us back to Ann Romney and her proclamation that she trusts her husband to make the inevitable hard choices that have to be made. Again, it was just her assertion. Whether you stand to gain or feel the pinch from those policies will determine whether you believe her.

Lawyer: Fiery Kenyan Muslim cleric killed
NAIROBI, Kenya (AP) ? A Kenyan lawyer says a controversial Muslim cleric facing terror-related charges has been killed.
Mbugua Mureithi said Monday that Aboud Rogo was shot dead by unknown assailants as he drove with his family in the coastal city of Mombasa. Rogo's father Abdallah Ali was in the vehicle and said Rogo's five-year-old daughter witnessed the shooting. Rogo's wife also was shot, in the leg.
In January Rogo was charged for possession of a cache of guns, ammunition and detonators. Rogo also faced charges of membership in an al-Qaida-linked Somali militia group which has been outlawed in Kenya. Police charged that Rogo was planning to bomb Kenyan targets over Christmas.
Rogo was acquitted on murder charges for the 2002 bombing of a tourist hotel which killed more than 12 people.

NY gunman quiet loner, victim outgoing family man
NEW YORK (AP) ? A gunman who killed a former co-worker in cold blood in the shadow of the Empire State Building and then was shot dead by police after he turned his gun on them spent long hours in the quiet of Central Park, photographing hawks and marveling over nature's beauty.
His victim was a gregarious salesman, beloved by his nieces and nephews as the fun uncle who could talk with equal expertise about the New York Jets and the women's fashion accessories he sold.
Investigators on Saturday were trying to piece together what caused Jeffrey Johnson, a T-shirt designer, to ambush Steve Ercolino, an apparel company vice president, a day earlier outside the Manhattan offices of the company where they once were colleagues.
Police said Johnson hid behind a car and then killed Ercolino with five gunshots as he arrived for work. Johnson then was shot by two police officers who confronted him on a busy sidewalk.
Security camera footage showed the officers had only an instant to react when Johnson suddenly turned as they approached and pointed his gun at them, his arm cocked as if to fire.
Their encounter was over in eight seconds. The officers, who had been standing nearly close enough to shake hands with Johnson and had no opportunity to take cover, fired almost immediately.
Nine bystanders were wounded in the 16-shot volley, likely by stray or ricocheting police bullets. None of their injuries was life-threatening, police said.
Police investigating Johnson's killing of Ercolino were eyeing bad blood between them from when they worked together at Hazan Import, a garment district business where Ercolino was a vice president of sales.
Johnson and Ercolino had traded harassment accusations when they worked together, police said, and when Johnson was laid off from the company a year ago he blamed Ercolino, saying he hadn't aggressively marketed his new T-shirt line.
After Johnson's layoff, neighbors said, he continued to leave his apartment every day in a suit.
Internet records listed Johnson as the administrator of the website for a business called St. Jolly's Art, which sold iron-on graphic art for T-shirts. Art for sale on the site included stylized drawings of fighter planes and muscle cars and whimsical "seafaring vignettes" featuring pirate maidens and tall ships.
Johnson also was part of a community of bird watchers and photographers who document hawks and other wildlife living in Central Park, a few blocks from his home.
In one email to another bird watcher who works at The Associated Press, Johnson wrote tenderly about spending a winter night watching ducks in the park.
"Near midnight by the Harlem Meer I watched a little 'flotilla' of Mallards swimming and softly honking ... fifteen degree temp and they were carrying on unfazed. Just remarkable," he wrote.
His photographs of Central Park's hawk population appeared regularly on blogs tracking the birds.
A neighbor who often saw Johnson, 58, said he was always alone.
"I always felt bad," said Gisela Casella, who lived a few floors above Johnson in a modest apartment building on the Upper East Side. "I said, 'Doesn't he have a girlfriend?' I never saw him with anybody."
Ercolino, 41, was described by his relatives as the opposite of a quiet loner.
His eldest brother, Paul Ercolino, said he was a gregarious salesman who often traveled, had a loving girlfriend and was the life of any family gathering.
"He was in the prime of his life," he said. "He would do anything for anybody at any time. ... He was so wonderful with my children. At Christmastime, he was the one who always had the best presents for the kids."
Paul Ercolino said his brother, known to nieces and nephews as Uncle Ducky because of his nearly blond hair, had followed his father into the garment industry after growing up in Nanuet, just north of New York City, then later worked in women's handbags and accessories. He said his brother had never mentioned to the family that he had any problems with a co-worker.
Hazan Import Corp. executives didn't return phone calls seeking comment Friday.
Johnson, after waiting for Steve Ercolino to come to work, walked up to him, pulled out a .45-caliber pistol and fired at his head, police Commissioner Ray Kelly said. After Ercolino fell to the ground, Johnson stood over him and shot four more times, a witness told investigators.
"Jeffrey just came from behind two cars, pulled out his gun, put it up to Steve's head and shot him," said Carol Timan, whose daughter, Irene Timan, was walking to Hazan Imports at the time with Ercolino.
In security camera footage released by the police, Johnson can be seen walking calmly down the sidewalk after the shooting, distancing himself slightly from the other pedestrians, who appear to have no awareness that anything is wrong.
But when two police officers approach in a hurry, Johnson turns and pulls a handgun from a bag. Then, the scene explodes into action. People seated on a bench behind the gunman and pedestrians standing close to the two officers run for their lives.
Only a young child seems not to react, strolling out of view of the camera as adults all around leap away in terror.
Startled New Yorkers later looked up from their morning routines in the crowded business district to see people sprawled in the streets bleeding and a tarp covering a body in front of the tourist landmark.
"I was on the bus, and people were yelling 'Get down! Get down!" accountant Marc Engel said. "I was thinking, 'You people are crazy. No one is shooting in the middle of midtown Manhattan at 9 o'clock in the morning.'"
It was over in seconds, he said ? "a lot of pop, pop, pop, pop, one shot after the other."
Afterward, he saw sidewalks littered with the wounded, including one man "dripping enough blood to leave a stream."
The officers who fired were part a detail regularly assigned to patrol landmarks such as the 1,454-foot-tall skyscraper since the Sept. 11 terror attacks, officials said.
Kelly, the police commissioner, said the officers who confronted Johnson had "a gun right in their face" and "responded quickly, and they responded appropriately."
"These officers, having looked at the tape myself, had absolutely no choice," he said.
A witness had told police that Johnson fired at the officers, but authorities say ballistics evidence doesn't support that. Johnson's gun held seven rounds, they said. He fired five times at Ercolino, one round was still in the gun and one was ejected when officers secured it, authorities said.
A loaded magazine was found in Johnson's briefcase.
Johnson legally bought the gun in Sarasota, Fla., in 1991, but he didn't have a permit to possess it in New York City, authorities said.
Mayor Michael Bloomberg said New York still is the safest big city in the country, on pace to have a record low number of murders this year.
"But we are not immune to the national problem of gun violence," he said of the shooting, following mass shootings at a Colorado movie theater and a Sikh temple in Wisconsin.
The nine people wounded outside the Empire State Building were all from New York City, except for a woman from Chapel Hill, N.C. They suffered graze wounds or other minor injuries.
Metal detectors and bag searchers have been standard at the Empire State Building since 1997, when a gunman opened fire on the 86th-floor observation deck, killing one tourist and wounding six others before fatally shooting himself.
The skyscraper remained open Friday throughout the mayhem, although its workers became witnesses.
"We were just working here and we just heard bang, bang, bang!" said Mohammed Bachchu, a worker at a nearby souvenir shop.
He said he rushed from the building and saw seven people lying on the ground, covered in blood.
Rebecca Fox said she saw people running down the street and initially thought it was a celebrity sighting, but then she saw a woman shot in the foot and a man dead on the ground.
"I was scared and shocked and literally shaking," she said. "It was like 'CSI,' but it was real."

Hello all...I'm not new here, but here is what is going on in a nutshell.? I have posted several times and gotten great feedback and once more I'm coming for more help.? My husband who has several serious issues (anger, bitterness, controling, bulling the kids, negative, critical) have played a major role in destroying the person I am over the past 10 years.? I see it effecting my kids as well.? I have told him how I feel and need him to get help so that our marriage works.? If not, seperation will be the next step.? Since that conversation, I see no improvments..yes, he is going to counseling,but keeps dishing out the same behaviors and attitudes that continue to hurt me.? I feel like I can't breathe and my health is going down the tubes in the meantime. I keep getting chipped away at and I see no remorse or caring about the damage he has done.? I keep getting defense and anger out of him.? Is this an indication that he doesn't care?? That's how I take it.? What do you think about my next step..things are getting much worse by the week and the kids I'm sure can sense the tense atmosphere.? Please Help!!!

Can I Drink Diet Soda Without Gaining Weight? (Diet Myth 5 ...
In my line of work, I get a lot of questions about how to lose weight and stay fit. I?m always amazed at how many myths there are about how food affects your health ? and your waistline.
With that in mind, we?ve been running through the top 6 diet myths of 2012. This week, let?s look at whether it?s time to kick the soda can.
Diet Myth 5: Artificial sweeteners are a great substitute for the real thing
No calories means no weight gain, right? That is what diet soda drinkers often think as they make another trip to the drink machine or convenience store.
Unfortunately, current research indicates a possible link between artificial sweetener consumption and weight gain and the health risks that go with it. A 2009 study in the journal Diabetes Care found that daily consumption of diet soda was associated with a 36 percent greater relative risk of developing metabolic syndrome ? a risk factor for diabetes, heart disease and stroke ?and a 67 percent greater relative risk of developing type 2 diabetes compared with nonconsumption. A more recent study in the American Journal of Clinical Nutrition found that, in one group of study participants, consuming artificially sweetened beverages was associated with type 2 diabetes. Another study in the same journal, led by Cleveland Clinic?s Adam Bernstein, MD, linked soda consumption directly to stroke risk.
Why soda with artificial sweeteners causes weight gain isn?t 100 percent clear, but animal studies have suggested that the body may process sweets ? artificial or not ? in a similar manner. In any case, if you keep artificial sweeteners in your diet, you never let your taste buds get a break from the sweet taste you crave. The more you drink diet soda, the longer you?ll remain trapped in the sugar cycle and continue to crave.
Looking to get your sweet fix without the addition of artificial sweeteners? Try the following tips:
- Spruce your water up the natural way. Freeze raspberries, blueberries, cucumber, mint, lemon or lime pieces in ice cubes and use them in your drinks. They?ll provide refreshing zing and, if you?re adding in raspberries or blueberries, a bit of sweetness as well.
- Take 1 cup of your favorite juice of choice (cherry and acai work well) and mix it with an entire pitcher of water. You?ll get the sweetness you?re looking for without the roller coaster blood sugar effect because the juice will be diluted. Just don?t drink the entire pitcher all at once; nurse it throughout the day.

A computer model that can identify the best molecular candidates for removing carbon dioxide, molecular nitrogen and other greenhouse gases from power plant flues has been developed by researchers with the U.S. Department of Energy (DOE)'s Lawrence Berkeley National Laboratory (Berkeley Lab), the University of California (UC) Berkeley and the University of Minnesota. The model is the first computational method to provide accurate simulations of the interactions between flue gases and a special variety of the gas-capturing molecular systems known as metal-organic frameworks (MOFs). It should greatly accelerate the search for new low-cost and efficient ways to burn coal without exacerbating global climate change.
Berend Smit, an international authority on molecular simulations who holds joint appointments with Berkeley Lab's Materials Sciences Division and UC Berkeley where he directs Berkeley's Energy Frontier Research Center, co-led the development of this computational model with Laura Gagliardi, a chemistry professor at the University of Minnesota.
"We've developed a novel computational methodology that yields accurate force fields - parameters describing the potential energy of a molecular system - to correctly predict the adsorption of carbon dioxide and molecular nitrogen by MOFs with open metal sites," Smit says. "All previous attempts at developing such a methodology failed and most people gave up trying, but our model is applicable to a broad range of systems and can be used to predict properties of open-site MOFs that have not yet been synthesized."
Smit and Gagliardi are the corresponding authors of a paper describing this research in the journal Nature Chemistry. The paper is titled "Ab initio carbon capture in open-site metal?organic frameworks." Co-authors are Allison Dzubak, Li-Chiang Lin, Jihan Kim, Joseph Swisher, Roberta Poloni and Sergey Maximoff.
Given that the United States holds the world's largest estimated recoverable reserves of coal, coal-burning power plants will continue to be a major source of our nation's electricity generation for the foreseeable future. However, given rising concerns over the contributions of burning coal to global climate change, there is an urgent need for an effective and economical means of removing greenhouse gases from flues before those gases enter the atmosphere. Current technologies proposed for capturing greenhouse gas emissions, based on amines or other molecular systems, would use about one-third of the energy generated by the power plants. This "parasitic energy" would substantially drive up the price of electricity.
MOFs are crystalline molecular systems that can serve as storage vessels with a sponge-like capacity for capturing and containing carbon dioxide and other gases. MOFs consist of a metal oxide center surrounded by organic "linker" molecules to form a highly porous three-dimensional crystal framework. When a solvent molecule is applied during the formation of the MOF and is subsequently removed, the result is an unsaturated "open" metal site MOF that has an especially strong affinity for carbon dioxide.
"MOFs have an extremely large internal surface area and, compared to other common adsorbents, promise very specific customization of their chemistry and could dramatically lower parasitic energy costs in coal-burning power plants," Smit says. "However, there are potentially millions of variations of MOFs and since from a practical standpoint we can only synthesize a very small fraction of these materials, the search for the right ones could take years. Our model saves this time by enabling us to synthesize only those that are most ideal."
Force field models developed to predict the adsorption properties of other MOFs typically underestimate the properties for open metal site MOFs by two orders of magnitude. This is because open metal site MOFs impose very different chemical environments from the MOFs that were considered in the original development of force field models. Smit and his colleagues met the challenge of open site MOFs using state-of-the-art quantum chemical calculations and a strategy based on the non-empirical model potential (NEMO) methodology.
"Under this NEMO methodology, the total electronic interaction energy obtained from quantum chemical calculations is decomposed into various contributing factors, such as electrostatic, repulsive, dispersion and so on," Smit says. "With the model we developed we were able to reproduce the experimental adsorption isotherms of carbon dioxide and molecular nitrogen and correctly predict the mixture isotherms at flue-gas conditions in Mg-MOF-74, an open metal site MOF that has emerged as one of the most promising for carbon dioxide capture."
The generality of their methodology should enable Smit and his colleagues to develop force field models for broad combinations of different metals, linkers and topologies. Work is already underway to apply the model to new amine-based systems for removing carbon dioxide from flue exhaust.

Researchers make quantum processor capable of factoring a composite number into prime factors
ScienceDaily (Aug. 19, 2012) ? Computing prime factors may sound like an elementary math problem, but try it with a large number, say one that contains more than 600 digits, and the task becomes enormously challenging and impossibly time-consuming. Now, a group of researchers at UC Santa Barbara has designed and fabricated a quantum processor capable of factoring a composite number -- in this case the number 15 -- into its constituent prime factors, 3 and 5.
Although modest compared to a 600-digit number, the achievement represents a milestone on the road map to building a quantum computer capable of factoring much larger numbers, with significant implications for cryptography and cybersecurity. The results are published in the advance online issue of the journal Nature Physics.
"Fifteen is a small number, but what's important is we've shown that we can run a version of Peter Shor's prime factoring algorithm on a solid state quantum processor. This is really exciting and has never been done before," said Erik Lucero, the paper's lead author. Now a postdoctoral researcher in experimental quantum computing at IBM, Lucero was a doctoral student in physics at UCSB when the research was conducted and the paper was written.
"What is important is that the concepts used in factoring this small number remain the same when factoring much larger numbers," said Andrew Cleland, a professor of physics at UCSB and a collaborator on the experiment. "We just need to scale up the size of this processor to something much larger. This won't be easy, but the path forward is clear."
Practical applications motivated the research, according to Lucero, who explained that factoring very large numbers is at the heart of cybersecurity protocols, such as the most common form of encoding, known as RSA encryption. "Anytime you send a secure transmission -- like your credit card information -- you are relying on security that is based on the fact that it's really hard to find the prime factors of large numbers," he said. Using a classical computer and the best-known classical algorithm, factoring something like RSA Laboratory's largest published number -- which contains over 600 decimal digits -- would take longer than the age of the universe, he continued.
A quantum computer could reduce this wait time to a few tens of minutes. "A quantum computer can solve this problem faster than a classical computer by about 15 orders of magnitude," said Lucero. "This has widespread effect. A quantum computer will be a game changer in a lot of ways, and certainly with respect to computer security."
So, if quantum computing makes RSA encryption no longer secure, what will replace it? The answer, Lucero said, is quantum cryptography. "It's not only harder to break, but it allows you to know if someone has been eavesdropping, or listening in on your transmission. Imagine someone wiretapping your phone, but now, every time that person tries to listen in on your conversation, the audio gets jumbled. With quantum cryptography, if someone tries to extract information, it changes the system, and both the transmitter and the receiver are aware of it."
To conduct the research, Lucero and his colleagues designed and fabricated a quantum processor to map the problem of factoring the number 15 onto a purpose-built superconducting quantum circuit. "We chose the number 15 because it is the smallest composite number that satisfies the conditions appropriate to test Shor's algorithm -- it is a product of two prime numbers, and it's not even," he explained.
The quantum processor was implemented using a quantum circuit composed of four superconducting phase qubits -- the quantum equivalents of transistors -- and five microwave resonators. The complexity of operating these nine quantum elements required building a control system that allows for precise operation and a significant degree of automation -- a prototype that will facilitate scaling up to larger and more complex circuits. The research represents a significant step toward a scalable quantum architecture while meeting a benchmark for quantum computation, as well as having historical relevance for quantum information and cryptography.
"After repeating the experiment 150,000 times, we showed that our quantum processor got the right answer just under half the time" Lucero said. "The best we can expect from Shor's algorithm is to get the right answer exactly 50 percent of the time, so our results were essentially what we'd expect theoretically."
The next step, according to Lucero, is to increase the quantum coherence times and go from nine quantum elements to hundreds, then thousands, and on to millions. "Now that we know 15=3x5, we can start thinking about how to factor larger -- dare I say -- more practical numbers," he said.
Other UCSB researchers participating in the study include John Martinis, professor of physics; Rami Barends, Yu Chen, Matteo Mariantoni, and Y. Yin, postdoctoral fellows in physics; and physics graduate students Julian Kelly, Anthony Megrant, Peter O'Malley, Daniel Sank, Amit Vainsencher, Jim Wenner, and Ted White.

L vs. Z: What Does it All Mean? | Absolute Transportation LLC Blog
You will frequently see us refer to L plates and Z plates in our discussion of limousine services in Connecticut.? So what exactly are we talking about??? License plates and the different service levels chauffeured vehicles can perform.

If you find the reservationist hesitating at this simple question, you are likely dealing with a less than reputable (or possibly illegal) company.? Also, out of state vehicles cannot come in to Connecticut to provide limousine services starting and staying within state lines.
Why Does Any of this Matter?

Abstract
Changes in the management of cancers such as colorectal?cancer?(CRC) are urgently needed, as such cancers continue to be one of the most commonly diagnosed cancers; CRC accounts for 21% of all cancers and is responsible for mortalities second only to?lung cancer?in the United States. A comprehensive science-driven approach towards markedly improved early detection/screening to efficacious targeted therapeutics with clear diagnostic and prognostic markers is essential. In addition, further changes addressing rising costs, stemming from recent health care reform measures, will be brought about in part by changes in how care is reimbursed. For oncology, the advances in genomics and biomarkers have the potential to define subsets of patients who have a prognosis or response to a particular type of therapy that differs from the mean. Better definition of a?cancer's behavior will facilitate developing care plans tailored to the patient. One method under study is episode-based payment or bundling, where one payment is made to a provider organization to cover all expenses associated with a discrete illness episode. Payments will be based on the average cost of care, with providers taking on a risk for overutilization and outliers. For providers to thrive in this environment, they will need to know what care a patient will require and the costs of that care. A science-driven "personalized approach" to?cancer?care has the potential to produce better outcomes with reductions in the use of ineffectual therapies and costs. This promising scenario is still in the future, but progress is being made, and the shape of things to come for?cancer?care in the age of genomics is becoming clearer.

Want to spend some time thinking about who your family is, and how the way you live reflects the way you really want to live, as opposed to the life that you?ve settled into, somehow, without much thought?
Then you may want to get a copy of ?Life at Home in the 21st Century,? an anthropological look at middle class American families ? or you may just want to take a look at your refrigerator door.
?Life at Home in the 21st Century? is the first book to come out of the? research in which the? Center on Everyday Lives of Families at the University of California, Los Angeles, followed 32 dual-income families with young children for, among other things, some 1,400 hours of videotaped interactions ? the research that gave us the phrase (from the author and researcher Anthony P. Graesch) ?the very purest form of birth control ever devised? and the comparison between the 5-year-old Amazon child who hauls logs and works the harvest while the 8-year-old American kid orders Dad to tie his shoe.
It?s a book focused on how we live within our homes ? on ?material saturation? and the way we create spaces, like serene master bedrooms and backyard patios, and yet spend all of our time bottled up in our kitchens and at our computers. And it?s a book about the way the spaces we live in reflect our lives, which brings us to the doors of our fridges.

Feeling a bit like a butterfly pinned to a card yet? Not only does the refrigerator in my house ?signal? our clutter, it also records my futile struggles against it. What does it say about the degree to which ?ephemera? has taken over our home that I have tried ? and failed ? to organize the front of our fridge?
First, there were the plastic magnetic picture frames. Nothing, I declared, belonged on the fridge except neatly in a frame, at right angles to everything else. One held a rotating cast of children?s art; another, a list of emergency phone numbers. It was the equivalent of stacking the piles on your desk. Remnants of that effort can still be seen in the picture (I can?t tell you how hard it was to keep from straightening things before I took it, but I resisted), along with last spring?s ?only magnets with sentimental value, or clips, or useful phone numbers? purge and the addition of new magnetic frames.
My refrigerator door is organizational challenge and defeat on a single surface. Failed attempts to organize too much stuff by buying more stuff. Efforts to involve others (the ?no leftovers? message is for the babysitter), lists, calendars: all meant to make things easier, better, more pleasant. The result is semi-organized, and a reflection not just of our life of semi-controlled chaos but of the duality of emotions that surround it. Material things, from magnets to toys to gadgets, cost far less in adjusted dollars than they ever did before, while time remains nearly as tightly budgeted as it ever was. The newest new thing is easy to get. Time to take care of the old thing, to put it away or give it away or even throw it away, is harder to come be, even when it?s as dumb as a refrigerator magnet.
That mentality ? the desire to buy a solution, or just treat yourself to a little material reward, instead of taking the time to do something more difficult or thoughtful, is reflected across many of our houses, including mine. It?s in our crowded playrooms, our overstuffed closets, and even in our so-busy schedules. And it?s apparently displayed prominently on our fridges. Don?t think something so ?seemingly unassuming? as the front of our refrigerators can really say something about a large slice of our society? The average family in the study had 55 objects on their fridge surface. I had 53. (The study author Dr. Graesch admits to 66 magnets alone.)
It looks like our refrigerators (and these researchers) have our number. What?s on your refrigerator door?

6 Ways To Talk To Your Kids' Grandparents About Rules
Dear Susan,
I have a lot of trouble getting my parents to enforce my rules about bedtime, appropriate snack foods, etc. when my children spend the night at their house. I have repeatedly told my mom and dad not to let the kids stay up late or eat lots of sugar -- but they let them do it anyway. I'm about to drop my kids off with their grandparents for a weeklong visit. What can I do to make it work for everyone?

Dear Stuck in the Middle,
My first response may not be to your liking, but I'm going to say it anyway: You can't force your parents to abide by your rules when they're watching your children. That said, you can ask them to talk with you in the hopes that you might come up with compromises they can live with. Here are some ideas:
1. Start by thanking your parents for their offer to watch your kids. After all, it is generous of them to take care of your children for a week. Do they know how much you appreciate them? If most of your communications are about what they do wrong, they're not likely to feel receptive to your requests about things you'd like them to do differently.
It means so much to me that you've invested time in creating a close relationship with the kids. You mean the world to them, and I'm grateful that you've offered to watch them next month.
2. Acknowledge your parents' point of view, which is as valid to them as yours is to you. By letting them know that you understand how tempting it is for them to give their grandsons and -daughters whatever they want, you'll reduce their defensiveness when you ask them to consider your preferences.
I know it's fun to spoil the kids, and I'm sure they push hard to get things I don't let them have when they're at home. It's hard to say no when they turn on those puppy-dog eyes...
3. Broach the topic of a "rules" discussion in a friendly way. Ask if your parents would be willing to talk with you about your children's upcoming visit so you can let them know about a couple of concerns you have. Narrow your requests to the one or two things that matter most to you, rather than delivering a long list of demands.
We've noticed that when the kids eat a lot of sugar, it really affects their moods -- especially Thomas, who ends up having trouble sleeping. It may seem like no big deal, but he gets crabby and easily upset when he hasn't had enough sleep. Would you be willing to limit the kids to one or two treats a day?
4. Listen to your parents' responses without telling them they're wrong. If you let your parents know that you respect their perspective, they'll be more open to yours.
5. Be patient. Give them time to think over your requests, rather than rushing them into promises they can't keep. The less they feel forced to do what you ask, the more they'll feel open to making concessions.
Please think about what you are and aren't willing to do. I don't want you to agree to anything you're not going to be able to stick to.
6. Be flexible. One of the things children love most about grandparents is that they let them get away with things their parents won't allow. And one of the best things about being a grandparent is having the chance to spoil those adorable grandkids. It's hard to relinquish control to others, but unless your parents are mistreating or neglecting your children, it may be best to accept that for a few days your kids will be off-kilter. Most kids recover fairly quickly from changes in routines, and the memories they'll have of their special time at Grandma and Grandpa's house will be priceless.
The bottom line: Approach your parents in a friendly way with requests for one or two changes that will help you feel more at ease. Avoid threatening to deprive them of their grandkids in an attempt to force them to do things your way, and don't damage the relationship with angry words because you disagree with their child-rearing philosophy. Most children love the special treatment they get at their grandparents' home, so if you can accept that the rules might be fudged a little bit, I'd suggest that you enjoy your break. Your kids may need a day or two to adjust -- and catch up on sleep! -- afterward, but they'll probably be just fine.

Legal News: Can You Copyright News Headlines?
This article addresses the law relating to copyright in news headlines and explores the case law relating to whether media publishers can protect their headlines as original literary works.
Media companies have tried to claim copyright protection over newspaper headlines reproduced on the internet. News publishers have claimed that news headlines qualify for copyright protection as original literary works under copyright legislation. As early as 1918 in the case of International News Service v Associated Press 248 U.S. 215 the US Supreme Court has held that there can be no copyright in facts or 'news of the day'.
However unlike in Commonwealth countries like Australia where there is no recognition of a tort of misappropriation the United States recognises a doctrine of misappropriation of hot news. This*tort has enabled media publishers and other organisations to gain the right to protect other entities from publishing certain 'facts' or data, including news and other time-sensitive information during a certain window period to enable the organisation which has invested in gathering the data can recoup their investment. There are a number of criteria which must be satisfied to prevail in an action of hot news misappropriation
As stated above, Commonwealth Courts have rejected a tort of unfair competition as framed in the United States and have decided such cases solely on the basis of copyright law. Courts have been reluctant to afford literary copyright to titles, characters and news headlines. However newspaper publishers have only recently brought legal action in Australia for copyright infringement in their headlines and portions of their articles on the basis that the reproduction or abstracting of headlines is equivalent to theft of their content. Newspaper publishers have tried to obtain copyright protection in their headlines as discrete original literary works under copyright legislation.
For copyright protection to exist a literary work must exist and not every piece of writing or printing will constitute a literary work within the meaning of the law.
Typically, single words, short phrases, advertising slogans, characters and news headlines have been refused copyright protection even where they have been invented or newly coined by an author. The courts have given different reasons for denying copyright protection to such works. One reason offered by the Courts is that the 'works' are too trivial or not substantial enough to qualify for copyright protection. The case of Exxon Corporation v Exxon Insurance Consultants Ltd (1981) 3 All ER 241 is a leading English precedent where copyright was refused for the word Exxon as an original literary work.
Exxon argued it enjoyed copyright in the word Exxon having invested time and energy in employing linguists to invent the word, contending that the actual size of the literary work doesn't preclude a work from acquiring copyright protection. The court found that the work was too short or slight to amount to a copyright work.
The Court also stated that although the word was invented and original it had no particular meaning, comparing it with the word 'Jabberwocky' used for Lewis Carroll's famous poem. US case law has only recognised limited intellectual property rights in invented names or fictional characters in exceptional cases. There is no modern English or Australian case which has recognised that titles, phrases, song and book titles should be granted copyright protection.
Publishers asserting copyright in headlines contend that compiling and arresting headlines involves a high degree of novelty and creativity, and that headlines should qualify as original literary works. To be a literary work, a work has to convey pleasure or afford enjoyment or instruction. A literary work must also be original, and to satisfy the test of originality it must be original not just in the sense of originating from an identifiable author rather than copied, but also original in the particular form of expression in which an author conveys ideas or information. This is because copyright is not meant to protect facts or ideas.
The question whether copyright can subsist in newspaper headlines was discussed briefly by a Judge in a Scottish case called Shetland Times Ltd v Wills [1997] FSH 604. The Judge didn't arrive at a final conclusion as to whether a newspaper headline can be a literary work, but expressed reservations about granting copyright to headlines, especially where they only provide a brief indication of the subject matter of the items they refer to in an article.
Newspaper headlines are similar in nature to titles of a book or other works and titles, slogans and short phrases which have been refused copyright protection. In the case of IceTV Pty Ltd v Nine Network Australia Pty Ltd [2009] HCA 14, the High Court held that no copyright can subsist in a programme title alone. The Courts have based their reasons for refusing copyright protection to such works both of the basis that they are too short (see Francis Day & Hunter Ltd v Twentieth Century Fox Corp Ltd (194) AC 112) or alternatively that titles of newspapers, songs, magazines, books, single words and advertising slogans lack sufficient originality to attract copyright protection.
The title 'Opportunity Knocks' for a game show was refused protection, as was the title "The Man who Broke the Bank at Monte Carlo" for a song and "Splendid Misery" for a novel. Courts have also refused copyright protection for invented names such as Kojak and newspaper titles such as 'The Mirror'. Such titles and names may however be protected by other forms of intellectual property such as trademark law or the tort of passing off.
Whilst Courts have recognised that newspaper headlines may involve creative flair and be clever and engaging but represent little more than the fact or idea conveyed.
Fairfax Media Publications Pty Ltd v Reed International Books Australia Pty Ltd the Federal Court of Australia has ruled that newspaper headlines are not capable of copyright protection. Reed and collected and reproduced the news headlines and articles appearing in the Australian Financial Review on it's Abix subscription service. Fairfax alleged that by producing abstracts of the articles in their service Reed had infringed the copyright in a number of works, being the headlines as a separate literary work and in the headline and article together, as a 'combination work', all of the articles, headlines and bylines as a 'compilation' and also published edition copyright in each of the Australian Financial Review. The Court held that the headline was too trivial to be copyrightable and did not amount to a substantial part of the combination work so as to amount to infringement and the combination work didn't amount to a work of joint authorship.

In the end, there was no doubting how much it meant to the Brazilians, as they collapsed in a jubilant heap after the match's final point, wrapped in each other and their own disbelief. Volleyball is a national passion, and after losing the men's soccer final to Mexico earlier in the day, a win here seemed a golden tonic. ?
Nor was there any doubting that it was a gold medal thoroughly deserved. From the second set of their four-set demolition of a US team ranked No. 1 in the world, their volleyball was irresistible. Feeding off a crowd that was overwhelmingly Brazilian and louder than a jumbo jet at takeoff, every block, dig, and spike was party waiting to be unleashed, a Brazilian flag dancing in every aisle.
But it came at a cost, and one that will only be more pronounced come 2016.?
The Olympic spirit.
The Olympics, after all, are not just another World League or Brazilian Superliga match.
They are the Olympics.
They are the place where American and Iranian wrestlers can stand atop the podium with nothing but friendship and mutual respect. They are where those who do not come first are cheered as earnestly as those who do. They are our two-week window into humanity's better nature, frankly. ? ?
And that was conspicuously absent at Earl's Court Saturday, as from the second set onward, the Brazilian fans booed loudly as every American stepped up to serve. ?
Whether or not it influenced the match or not is immaterial. If it did, it was only in helping the Brazilian team, which is notorious for playing on emotion. The US women, who face crowds much worse than this when they play on the road, probably found this tame. The booing is no excuse for their collapse after dominating the first set 25-11, and to their credit, the players did not try to make it one.
It is also immaterial whether it was malicious. "It's their culture," said American outside hitter Logan Tom after the match. "It's not an insult."
Indeed, the Brazilian fans cheered heartily for the US and for bronze-medal winners Japan after the match. And for the players, this was a true Olympic moment. Yes, their medal-stand celebrations might have been a bit jarring to the American eye, but it was also hard not to share at least a little in the joy of their achievement.?
The greater issue is what this heralds for Rio 2016.
On one hand, it leaves no doubt that the Brazilians are going to have a lot of fun. As the fans were waiting for the medal ceremony, a drum emerged from somewhere (how did that get through security?)?and the crowd erupted into chants and songs brimming with national pride.?
But was there really ever any doubt that Rio would be a party? This is Rio, after all.?
It also suggests that the Brazilian athletes will get more than a polite welcome. And at sports close to Brazilians' hearts, the the crowd noise might be heard in Buenos Aires. "They support the sport of volleyball to a level not seen in the rest of the world, and I respect that," said American setter Lindsey Berg.?
Certainly, the crowd's passion elevated the Brazilians Saturday as the Americans came unglued. What was the most technically proficient team in the women's game at times looked as sloppy as high schoolers, as Brazil, seen as inconsistent and on a downward slope before the tournament began, gradually found their old samba swagger. By the fourth set, the US resembled nothing so much as a bug on the Brazilian windshield.
Athletes competing against Brazil in 2016, be warned. ?
That atmosphere can create a drama of its own?? a team going into a lion's den and refusing to be cowed. The triumph of standing in a cauldron of sound all willing you to fail, and still stubbornly finding that spot of sublime achievement.?
But is that the Olympics?
In four years, we may find out.
